Restricted and Prohibited Burning Periods

The Restricted Burning Period runs in two parts each year: October 1 – October 31 and March 9 – April 30. A Shire permit is required before lighting any fire, including garden refuse or rubbish.

The Prohibited Burning Period extends from November 1 – March 8. No burning is permitted for any reason—campfires, open cooking, and garden waste are all prohibited.

These fixed periods may be extended or shortened depending on local seasonal conditions. Always confirm the current status through the Shire of Toodyay website or official SMS alerts for Harvest, Vehicle Movement & Hot Works Bans.

Permits

Apply at least four days in advance with full property details. Burns within 3 km of DBCA land require separate notification.

Emergency “Ban on Lighting of Fires” Declarations (Section 46)

In addition to the fixed burning seasons, the Shire may issue short-term emergency directions under Section 46 of the Bush Fires Act 1954 when conditions suddenly become dangerous—typically due to hot, dry, or windy weather.

Example – Direction Notice (May 2020):
“Pursuant to Section 46(1A)(a) and (b) of the Bush Fires Act 1954, due to dry conditions and a forecast Very High Fire Danger Rating, the Chief Bush Fire Control Officer for the Shire of Toodyay prohibits the lighting of any fire within the Shire from 1200 hrs Saturday 23 May 2020 until 2359 hrs Sunday 24 May 2020. Any existing fires were to be extinguished by 1200 hrs Saturday and monitored until complete out.”

Such orders are time-limited, usually lasting 24–48 hours, and override any existing permits. Failure to comply is an offence under the Act.

Burning Road Verges

Burning or allowing fire to cross onto a verge is illegal unless specifically authorised. A permit may be issued only where no other risk-reduction method is practical and must include a compliant Traffic Management Plan.

🔥 Solid-Fuel Appliances in Prohibited Periods

According to written correspondence confirmed by the Chief Executive Officer of the Shire of Toodyay (December 2023), solid-fuel appliances such as wood-fired stoves, ranges, pizza ovens and heaters may be used year-round provided they are operated within a fully enclosed structure (for example, inside a dwelling).

The Shire clarified that semi-enclosed areas — including patios, verandas or sheds with openings — are considered “open air” and therefore not compliant under local fire-safety provisions.

Use of any solid-fuel appliance is still prohibited during a declared Total Fire Ban. Residents remain responsible for ensuring their activity cannot cause ignition and for checking the current ban status at emergency.wa.gov.au or via toodyay.wa.gov.au.

Legal Penalties and Compliance

Under the Bush Fires Act 1954 (WA), offences may attract fines up to $25 000 and/or 12 months imprisonment. Liability for firefighting costs and civil damages may also apply.

Frequently Asked Questions – Fire Safety & Burning at Home

🔥 Can I have a campfire, fire pit, or wood-fired BBQ at home?

It depends on the season and the current fire-ban status.

  • Restricted Burning Period (Oct 1 – 31 and Mar 9 – Apr 30):
    Small, contained cooking or heating fires such as wood-fired BBQs, pizza ovens, or campfire-style cooking fires are permitted on private property if they are attended at all times, have at least 3 m of cleared space around them, a hose or water supply is ready, and the fire is fully extinguished after use. Burning off vegetation, rubbish, or garden waste still requires a Shire permit.
  • Prohibited Burning Period (Nov 1 – Mar 8):
    No solid-fuel fires of any kind are allowed — this includes campfires, open BBQs, and pizza ovens. Only gas or electric BBQs may be used, provided they are safe, attended, and have a 5 m cleared area.
  • Outside of the burning season (typically May – September):
    Cooking or recreational fires are generally allowed, but always keep them small, supervised, and clear of dry grass or bush.

🏡 Can I use my indoor wood stove, range, or pizza oven?

Yes. The Shire of Toodyay CEO confirmed in December 2023 that solid-fuel appliances operated inside a fully enclosed structure (for example, within your home) may be used year-round, including during the Prohibited Burning Period. However:

  • During a declared Total Fire Ban: all solid-fuel appliances — even indoors — must not be used. These bans override all other approvals.
  • Make sure no smoke, sparks, or embers can escape to the outside environment.
  • Keep flues and chimneys well maintained and install a spark arrestor where possible.

🚫 What about semi-enclosed areas like verandas, patios, or sheds?

Semi-enclosed or partially open structures — such as verandas, patios, garages, or sheds with openings — are legally treated as “open air” during fire restriction periods. That means what you can do depends on the season and the type of fire ban in place:

  • 🔥 Restricted Burning Period (Oct 1 – 31 and Mar 9 – Apr 30):
    You may use a small, contained solid-fuel appliance such as a wood-fired BBQ, fire pit, or pizza oven in a semi-enclosed space only for cooking or warmth — never for waste burning. It must be fully attended, have at least 3 m of cleared ground around it, a hose or water source ready, and be completely extinguished after use.
  • 🚫 Prohibited Burning Period (Nov 1 – Mar 8):
    No solid-fuel fires of any kind may be used in semi-enclosed or outdoor areas. Only gas or electric cooking appliances are permitted, and they must have at least 5 m of cleared area.
  • 🚨 Total Fire Ban:
    All solid-fuel use is strictly prohibited — indoors, outdoors, or semi-enclosed. These bans override all other allowances or permits.
  • ✅ Outside the burning season (typically May – September):
    Semi-enclosed cooking or heating fires are generally permitted, provided the area is safe, attended, and clear of flammable material. Always ensure smoke or embers cannot escape to nearby vegetation.

💨 Can I burn garden waste, leaves, or rubbish?

Only with a permit during the Restricted Burning Period. Burning of garden refuse, stubble, or rubbish is not allowed during the Prohibited Burning Period or while a Total Fire Ban is in force.

  • Apply for a permit at least four days before your intended burn via the Shire.
  • Have at least two people present, along with water, hoses, or firefighting tools.

    The correspondence (Ref OCR65904) confirms that solid-fuel appliances such as wood-fired stoves, ranges, pizza ovens and heaters may be used year-round when operated within a fully enclosed structure (e.g., inside a dwelling), but not in semi-enclosed areas such as patios or verandas, and never during a declared Total Fire Ban.

    This statement remains current as of October 2025. No public amendment or Council decision has been published rescinding or altering this position. Statewide Total Fire Ban and Bush Fires Act 1954 provisions continue to apply.

    Harvest and Vehicle Movement Bans

    A Harvest and Vehicle Movement Ban may be applied during the Restricted or Prohibited Burning Period. The Shire of Toodyay will determine the need for a ban and advertise it via the Harvest Ban SMS Notification System.

    • Harvest Ban: A ban on all harvesting operations on all properties within the Shire of Toodyay.
    • Vehicle Movement Ban: A ban on all vehicle movements on properties within the Shire of Toodyay, except for essential watering of stock (using a diesel-powered vehicle only).
    There is an automatic ban on harvesting and vehicle movement on Christmas Day, Boxing Day, New Year’s Day and Australia Day each year.
    Hot works such as welding, cutting, or grinding must comply with Bush Fires Regulations 39C (applicable at all times). However, the Shire strongly recommends postponing such works during Harvest, Vehicle Movement and Hot Works Bans. Shire of Toodyay – Fire Control Officers
